What scammers do in this phase?
Scammers take money from non-H1B visa workers (L1A, L1B, H4, B1, F1, OPT, CPT etc) for filing new H1B petition to USCIS.
Scammers take visa fee indirectly as “Personal Deposit” or “Security Deposit” or “Personal Fee” or “Security Fee” to avoid detection for this violations.
Scammers do visa abuses, violations & cheating.

What happens in this phase?
Scammers take money (varies from $5000 to $10000) from non-H1B visa workers for filing new H1B visa petition. Scammers also promise that this money will be returned back along with first paycheck.
Taking money for H1B visa is illegal and many failed scammers got nabbed & punished due to this scam.
Now, you must be wondering why do expert scammers take such a huge (jail-going) risk by taking money from non-H1B visa workers, though scammers return this money back to non-H1B visa worker in the first paycheck.

What reason scammers tell to non-H1B visa workers while taking money for H1B visa?
Usually, scammers tell non-H1B visa workers that they (scammers) take money to ensure that non-H1B visa workers must join their company after approval of H1B visa. Once non-H1B visa worker joins their company, scammers return this visa fee back to visa worker.
The reason sounds pretty reasonable, isn’t it?
But it is not the real reason.

Do you think scammers will take the risk of going to jail just to ensure that non-H1B visa worker joins their company?
No way. And this is not the real reason.

So, what is the real reason?
The real reason is: scammers use non-H1B visa worker’s money as a trap to blackmail non-H1B visa worker to sign backdated offer letter after approval of H1B visa petition (This is very important, please pay special attention).

Isn’t this reason weird?
Yes this reason looks weird, but it's true.
As mentioned before, to lure non-H1B visa workers, scammers promise many things. But scammers never intend to mention any of those promises in the offer letter. Scammers actual terms & conditions in offer letter is completely different from the promised one.

The offer letter is more of a trap for non-H1B visa worker. If any non-H1B visa worker will see offer letter before giving money (visa fee) to scammers, then no non-H1B visa worker will sign offer letter & will never join the company.

So, visa workers money is one of the traps, scammers use to blackmail non-H1B visa worker to sign backdated offer letter after the approval of H1B visa petition.

After giving money, if non-H1B visa worker refuses to sign the offer letter, then non-H1B visa workers will lose their entire money (visa fee). And worst of all, non-H1B visa workers can’t even complain to USCIS, because scammers tricked them (non-H1B visa workers) to write “Personal Deposit” or “Security Deposit” or “Personal Fee” or “Security Fee” on visa fee check.

Why do scammers return visa fee back to non-H1B visa workers?
Isn’t non-H1B visa worker will be trapped more firmly, if scammers won’t return visa fee to non-H1B visa workers?
Excellent question.
Simple answer is: to make this scam perfect (& to prevent this scam from getting busted).
Logically, non-H1B visa worker will be trapped more firmly, if scammers will keep as much visa workers money as possible.

Now, you must be wondering: Why do scammers return visa fee back to non-H1B visa workers?
How this action of scammers make whole scam perfect?


Here are those 2 reasons, because of which scammers return visa fee back to non-H1B visa workers (There might be more, which I am not aware of):
Fear of getting caught & chances of going jail:
Scammers take this money for filing H1B visa petition. It is illegal to take money for filing new H1B visa. So, if any non-H1B visa worker will complain to USCIS, then there are good chances that the whole scam will be busted and scammers might go to jail. So, scammers return entire visa fee to non-H1B visa worker along with first paycheck.


Revert back visa abuses/violations:
By returning visa fee, scammers revert back visa abuses/violations after the purpose of taking visa fee is met. One of the purposes of taking visa fee is to trap non-H1B visa worker. So, even if scammers do visa abuses & violations (taking visa fee is visa abuses/violations), then also, scammers can never be caught & never be punished for these abuses & violations.
